Default Biggie Smalls Defamation Case Dismissed

judge has thrown out a lawsuit filed by a Tyruss “Big Syke” Himes who claimed Fox-owned KTTV-TV in Los Angeles and XXL magazine falsely accused him of being involved in the murder of Biggie Smalls. The Judge dismissed the motion on grounds that the stories were protected by free speech. The Judge also stated that Himes failed to demonstrate that the stories were created in a malicious and reckless way, which is the standard of proof in a defamation case.
Himes, a friend of Tupac who worked with him on Loyal To The Game sued Fox and XXL magazine in July, 2006, claiming he lost a record deal because the TV station aired a news report implicating him in BIG’s murder. XXL printed an article in 2005 stating that he was “involved in assembling the team” to murder BIG.

“We are appreciative of the time and effort the court put into reviewing the case. We’re understandably disappointed in the decision and we’re evaluating all of our options.” Said Himes attorney, Arthur G Lesmez.
