When the Southern states seceded, secession was not illegal. In fact, Lee was never brought to trial for treason after the war. Those trials would have settled the question legally. However, military force is what settled the question of secession.

The Constitution has been defied for a long time now. Social Security, Welfare, Federal Reserve, etc are all unconstitutional. And Congress isn't keen on declaring war when needed. So while we have a Constution in theory, we don't follow it in practice.

Our government was essentially established on a loosely based constitution. If it were strictly enforced, we wouldn't have the America we have today. So we treat the constitution as a guideline rather than a set form of rules.
